PAR 217 - Real Estate Legal Procedures

3 Credits, 3 Contact Hours

Legal procedures and requirements in real estate transactions and litigation. Includes real estate principles and legal concepts, recording and constructive notice, and real property taxes. Also includes an analysis of real estate contracts and purchase agreements, escrows and closings, deeds, co-ownership, legal descriptions, leases, encumbrances, liens, and foreclosures.

Prerequisite(s): PAR 101  
Information: Employment in a legal-related field or an Arizona Real Estate license may be substituted for PAR 101 . See a PAR Advisor or course instructor for prerequisite information.

Course Learning Outcomes
  1. Contrast the distinctions between real property, personal property and fixtures. 
  2. Prepare documents in proper form for recording. 
  3. Examine records of the County Recorder, County Assessor, and County Treasurer. 
  4. Examine a purchase agreement for a real property transaction. 
  5. Demonstrate the ability to review a title report and understand the closing process. 
  6. Prepare various types of deeds. 
  7. Analyze the forms of co-ownership used in Arizona, including creating and breaking a joint tenancy. 
  8. Analyze a real property legal description. 
  9. Apply Arizona Landlord and Tenant Law in the drafting of various clauses in leases. 
  10. Evaluate encumbrances on real property, including analysis of voluntary and involuntary liens. 
  11. Analyze procedures and documents for judicial and non-judicial foreclosures.
